Terms of sale

These “General Terms of Sale” apply to online purchases of parts from the shop of the PRV Concept Association.

Article 1: Purpose
These terms of sale define the contractual relationship between the PRV Concept Association and the customer, and the conditions applicable to any purchase made on the site, whether the Customer is a business or a private individual.
Purchasing a Product implies the Customer’s unreserved acceptance of these terms of sale.
These terms of sale prevail over any other general or specific terms not expressly agreed to by the PRV Concept Association.
The PRV Concept Association reserves the right to modify the terms of sale at any time. The applicable terms are those in force on the date of the Customer’s order.
Article 2: Force majeure
The obligations set out in these General Terms of Sale will be suspended in the event of force majeure as defined by the case law of the French courts. The parties’ respective obligations will first be suspended for the whole duration of the event, with the exception, however, of the obligations set out in Article 14 and in the Appendix.
Article 3: Product characteristics
The Product is the one presented on the page of the site that describes it and contains the purchase button.
Article 4: Price
The price shown on the sales page is in Euros, all taxes included.
Every order, whatever its origin, is payable in euros.
The PRV Concept Association reserves the right to change the price at any time. The price shown on the sales page on the day of the order is the only one applicable to the Customer.
Should the Customer be unable to use the PayPal.com payment site (see Article 5), or not wish to use it, any additional amount to be paid is borne by the Customer, including shipping costs and local, national or international taxes and fees. PayPal does not charge any additional fee. The Customer is therefore invited to use this means of payment rather than another.
Customers located outside metropolitan France are invited to inquire about any import duties or taxes that may apply, and are responsible for declaring and paying them.
Article 5: Payment terms
Payment is due when the order is placed.
Failure to pay results in the suspension or cancellation of the order.
Payment is made by bank card. It is processed through the secure PayPal.com site (PayPal Europe S.à r.l. & Cie, S.C.A. 22-24 Boulevard Royal. 5th floor. 2449 Luxembourg), which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and cannot be read by any third party while in transit over the Internet.
The Customer does not need a PayPal.com account to pay for the order. On the PayPal.com payment page, there is an option for people without a PayPal.com account that the Customer can use.
As the PRV Concept Association is not responsible for the paypal.com site, it can in no case be held liable by the Customer for the consequences of the Customer’s misuse of the PayPal.com site, nor for that site being unavailable should this occur.
The Customer’s account will be debited immediately.
At the express request of the Customer, made by post or email, an invoice will be sent in electronic PDF format bearing the statement “VAT not applicable, art 293B of the CGI”.
Article 6: Delivery area
Sale of the Product on the Site is reserved for Customers whose country of residence is authorised by PayPal.com (about 140 countries – see the list on the PayPal.com site).
Article 7: Order
The Customer acknowledges having checked that the Product suits their needs and having received from the publisher all the information necessary to enter into this commitment with full knowledge of the facts.
The Customer declares that they are at least 18 years old and have legal capacity, or hold parental authorisation allowing them to place an order on the Site.
The Customer declares that the bank account linked to the payment card, or the PayPal.com account used for payment, is their own, or that they have the legitimate authorisation of its owner to use it.
A Customer who wishes to buy the Product must:
– click on the order link on the sales page to reach the secure PayPal.com payment site;
– confirm the order after checking it;
– make the payment on the PayPal.com site under the stated conditions, giving a valid and working delivery email address whose inbox is accessible.
Payment of the order on the PayPal.com site, or by any other means agreed beforehand, implies acceptance of these terms of sale, acknowledgement of full knowledge of them, and waiver of the right to rely on the Customer’s own purchasing terms or any other terms.
Payment of the order on the PayPal.com site constitutes confirmation of the order.
Article 8: Proof of the transaction
All the data provided and the confirmation recorded on the PayPal.com payment site will constitute proof of the transaction. The confirmation will constitute signature and acceptance of the operations carried out.
Article 9: Delivery
The Product is delivered by Colissimo, a service of the French postal service La Poste, and only by this means, unless otherwise agreed with the PRV Concept Association before ordering.
The delivery price of an order is stated precisely before it is confirmed. The delivery date of an order is stated precisely before it is confirmed. If the delivery time is exceeded by 14 days, the customer may request termination of the contract by registered letter with acknowledgement of receipt.
If the product is not received, the Customer must contact the publisher by post or email within thirty days of the payment date on PayPal and may demand a refund of the order.
By placing an order, the Customer declares having first checked that their postal address is valid and that their letterbox is accessible.
The PRV Concept Association must in all cases meet the delivery times. The PRV Concept Association must prove that it is not responsible for any delay in delivery.
Article 10: Order confirmation
The PRV Concept Association will send an order confirmation by email. This email is sent automatically by the e-commerce system used on the Site.
No other email will be sent, except at the express request of the Customer made by post or email.
Article 11: Right of withdrawal and refund
A Customer who is a consumer has fourteen days from receipt of the Product to exercise their right of withdrawal, without having to give any reason (articles L221-18 et seq. of the French Consumer Code). They notify the PRV Concept Association of their decision by post or email, then return the Product to it, complete and in its original condition, no later than fourteen days after this notification. Return costs are borne by the Customer.
The PRV Concept Association refunds all sums paid, including the initial delivery costs, no later than fourteen days after being informed of the withdrawal; it may withhold the refund until it has received the returned Product. The refund is made using the means of payment used for the order.
The right of withdrawal does not apply to Products made to the Customer’s specifications or clearly personalised (article L221-28 of the French Consumer Code).
Article 12: Commitments of the PRV Concept Association
The PRV Concept Association undertakes to exercise all necessary care and diligence in supplying a quality product and service in accordance with professional practice and the state of the art, particularly in its communication with the Customer.
The PRV Concept Association undertakes to take all reasonable precautions to ensure the physical protection of the Customer’s personal data and to keep it confidential.
Article 13: Liability
The PRV Concept Association is bound only by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet, such as data loss, intrusion, viruses, service interruption or other unintentional problems.
The Product complies with the French legislation in force and with the standards applicable in France. The publisher cannot be held liable for non-compliance with the legislation of the country where the Product is delivered. It is up to the Customer to check with the local authorities of their country of residence whether the Product they intend to order on the Site may be used there.
The PRV Concept Association cannot be held liable for non-delivery of the product if the Customer’s postal address given on the PayPal.com payment site or by any other means is out of date or invalid, or if the Customer’s letterbox is inaccessible or not working. If the ordered Product is not received, the Customer must follow the instructions given in Article 9.
Article 14: Intellectual property
All elements of the Site, including the Product and its appendices, are and remain the exclusive intellectual property of the PRV Concept Association.
Unless explicitly stated otherwise on the Site, or under an explicit licence, no one is authorised to reproduce, exploit, redistribute or use in any capacity whatsoever, and by any means whatsoever, in whole or in part, any elements of the Site, whether editorial, software, audio or visual.
Article 15: Personal data
The PRV Concept Association undertakes that the collection and processing of the Customer’s personal information carried out on the Site comply with French law no. 78-17 of 6 January 1978 on information technology, data files and civil liberties, known as the “Informatique et Libertés” law.
The information recorded will not be transferred without the Customer’s prior consent.
The PRV Concept Association guarantees the Customer a right to object, access, rectify and delete personal data concerning them.
The Customer may exercise this right by post or email, stating their first name, last name and email address.
Article 16: Archiving and proof
The PRV Concept Association will archive transaction data on a reliable and durable medium constituting a faithful copy.
The publisher’s computerised records will be considered by the parties as proof of the communications, orders, payments and transactions between the parties.
Article 17: Severability
Should any of these terms prove to be void, that clause would be deemed unwritten but would not render the rest of the general terms of sale void, which would therefore remain fully valid.
Article 18: Dispute resolution
These online terms of sale are governed by French law, wherever they are used or the purchase is made.
In the event of a dispute over the interpretation or performance of these terms of sale, and failing an amicable agreement between the parties, the courts of Nantes alone will have jurisdiction.
